Partial unemployment: exceptional measures in Coronavirus emergency

The Coronavirus is putting a strain on employees and employers, and forced SECO on March 20 to issue exceptional measures for entrepreneurs and companies in an attempt to stem the economic consequences of the lack of liquidity.

Due to the exceptional situation declared, as well as the closure of schools and most stores for several weeks, companies are facing unexpected situations, even in sectors not initially considered affected. For this reason, SECO issued new directives and measures on 20 March.

Who is entitled to partial unemployment compensation?

Contrary to the traditional provisions, short-time work compensation is now extended to all positions: whether they have a specific contract, apprenticeship or temporary contract, as of March 20 all employees will be entitled to short-time work compensation. 
In addition, employees in a position similar to that of their employer will also be entitled to this allowance, such as associates in the case of an Sagl or their spouse and registered partner.

How long does it take to trigger the short-time work allowance?

The waiting time has been enabled. With increasing provisions, the Council of State has decided to lower the waiting time from the traditional 2 weeks initially to 3 days and now the allowance is paid automatically.

How to apply for partial unemployment allowance?

To qualify for the allowance, simply submit the short-time work notice form to the canton.

What are the key requirements for access to the partial unemployment allowance?

There are essentially three key requirements:

  • that the employee accepts;
  • that the employment contract between the employer and the employee has not been terminated;
  • that the employee's decline in turnover and productivity be proven with objective documents.

In the preannouncement application, in fact, it is necessary to prove the decrease in turnover by listing the monthly turnover for the last 4 years, attaching any further available evidence such as site closures, impossibility to find material, decrease in customers, etc.. After obtaining the authorisation, the number of hours lost by each employee must be determined on the basis of the stamps.
